CONTRACT
1. Session Location
All photography services will take place at lastphoto.KC's studio, currently located at:
1321 W. 13th Street
Kansas City, MO 64102
2. Booking & Payment Terms
Session Fee
A non-refundable session fee of $750 is required to reserve a session date. A date is not secured until this Agreement is signed and the session fee is paid.
The session fee is separate from all other fees, including product purchases, reschedule fees, cancellation fees, or no-show fees. No portion of the session fee may be applied to any other fee or obligation.
Minimum Product Investment (Prepayment Required)
A minimum product investment of $990 is required in addition to the session fee.
The $990 minimum investment must be:
Paid in full no later than 30 days prior to the session date, OR
Placed on an approved payment plan within 30 days of booking
Failure to initiate payment within 30 days of booking will result in:
Immediate removal from the calendar
A $500 cancellation fee
All payments—including the session fee, product investment, and any prepayments—are separate and non-applicable toward any fees (including cancellation or no-show fees).
Late payments incur a $25 per day late fee. Balances more than fourteen (14) days past due may be sent to collections.
3. Ordering Appointment & Sales Policy
Image reveal and ordering will occur immediately following the session (same-day IPS).
All image selections, artwork credits, and product orders must be finalized at that appointment.
Because all artwork and products are custom-created:
All sales are final.
No refunds, exchanges, downgrades, or cancellations will be permitted for any reason.
Orders not placed at the reveal appointment may expire and may require a new order minimum to reinstate.
Product pricing begins at $990 and may increase based on selections.
4. Rescheduling, Cancellation & No-Show
Rescheduling
First reschedule: $250
Second reschedule: $500
Any additional reschedule will be treated as a cancellation and subject to a $500 cancellation fee
All reschedule fees are separate and cannot be applied to session fees, product purchases, or any other charges.
Client Cancellation
All client-initiated cancellations are subject to a $500 cancellation fee, regardless of timing.
The cancellation fee is not covered by, and cannot be applied against, any session fee, product prepayment, or other payment made.
The $750 session fee remains non-refundable.
No-Show
Failure to appear or arrival more than fifteen (15) minutes late without prior communication constitutes a no-show.
A no-show will result in:
Forfeiture of the session
A $500 no-show fee
All no-show fees are separate and cannot be offset by the session fee, product prepayment, or any other payment.
5. Client Preparation & Studio Condition
Camera-Ready Requirement
Hair and makeup services are not included. Client agrees to arrive fully camera-ready.
The session will begin at the scheduled start time regardless of Client preparedness. Preparation during session time reduces shooting time and does not extend the session.
If Client arrives unprepared in a way that materially interferes with the session, the Photographer may shorten or terminate the session without refund.
Body Products, Paint, Glitter & Transferable Materials
Client must disclose in writing before the session any intent to use:
Body paint
Oils applied immediately before session
Glitter or shimmer products
Self-tanner not fully developed
Spray products
Any material capable of staining, shedding, transferring, or damaging studio property
Use of such materials is subject to Photographer approval and may be denied at any time.
Damage & Cleaning Responsibility
Client accepts full financial responsibility for:
Staining
Fabric damage
Upholstery damage
Backdrop contamination
Equipment cleaning or repair
Excessive cleaning or specialty remediation
Client authorizes charges to the card(s) on file for all repair, replacement, and cleaning costs.
The Photographer may terminate the session without refund if studio property is damaged or contaminated.
6. Editing Policy
Standard retouching is provided at the Photographer’s discretion and may include minor skin smoothing and blemish removal.
Advanced editing (including body reshaping, tattoo removal, stretch mark removal, braces removal, or alteration of permanent features) must be requested in writing and is billed starting at $99 per image.
The Photographer reserves the right to decline edits that compromise artistic integrity.
7. Delivery & File Storage
Final edited images and products will be delivered within:
Six (6) weeks after the reveal appointment
Up to eight (8) weeks during peak months (November–February)
Digital files are delivered electronically.
Files are not guaranteed to be stored beyond 90 days after delivery. Clients are responsible for downloading and backing up all files.
8. Copyright & Image Rights
All images remain the sole property of Laura Straub d/b/a lastphoto.kc and are protected under United States Copyright Law.
Clients purchasing digital files receive a limited, non-transferable personal-use license.
Clients may not alter, crop, edit, reproduce, sell, distribute, or commercially use images without written permission.
Unauthorized use constitutes copyright infringement.
The Photographer retains full artistic control over final edits and presentation.
9. Model Release (Default Release)
Client grants permission for images to be used for portfolio, website, social media, advertising, and promotional purposes.
To opt out, written notice must be received no later than 11:59 PM CST on the day of the session.
If notice is not received by that time, removal from marketing materials or the internet is not guaranteed.
10. Client Conduct
No guests are permitted unless approved in writing.
Any inappropriate, threatening, harassing, or disrespectful behavior will result in immediate session termination without refund.
11. Limitation of Liability & Force Majeure
Client releases and holds harmless the Photographer from claims arising from participation in the session.
If circumstances beyond control (illness, natural disaster, equipment failure, etc.) prevent the session, reasonable efforts will be made to reschedule. No refunds will be issued. Funds may be applied to a future session within six (6) months.
12. Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of the State of Missouri.
Any dispute shall be resolved through binding arbitration in Jackson County, Missouri.
Initiating a chargeback in violation of this Agreement constitutes breach of contract. This signed Agreement serves as authorization for all charges described herein.
The prevailing party may recover reasonable legal fees and costs.
